Intestate Succession

Where a person dies without a valid will in Turkey, their estate passes according to the statutory rules of the Turkish Civil Code (Articles 495–574). The statutory heirs are ranked in order of priority: descendants, then parents and their descendants, then grandparents and their descendants, then the surviving spouse (who also has concurring rights with other heirs). The state is the heir of last resort where no other heirs exist.

Wills in Turkey

Turkish law recognizes three types of wills: (1) official (resmi vasiyet), made before a notary and two witnesses; (2) holographic (el yazılı vasiyet), written entirely by hand, dated and signed; and (3) oral (sözlü vasiyet), available only in emergency situations and subject to strict formalities. We advise on the most appropriate form and draft wills that clearly express testamentary intent while complying with all formal requirements.

Forced Heirship (Saklı Pay)

Turkish Civil Code guarantees forced heirs — descendants, parents and the surviving spouse — a mandatory share of the estate (saklı pay / reserved portion) that cannot be reduced by will. Descendants are entitled to 50% of their statutory share; parents to 25%; the surviving spouse's reserved share varies depending on the co-heirs. Gifts and dispositions that infringe forced heirship rights are subject to reduction claims (tenkis).

Cross-Border Inheritance

For estates involving assets in Turkey and abroad, or heirs resident in different countries, private international law principles apply. We advise on applicable law, recognition of foreign wills and court decisions, and estate administration for international estates.
